End User License Agreement (EULA) for NFTouring The Club

Effective Date: March 1, 2024

IMPORTANT: The company Carfooly (« we, » « our, » « us »), operating the NFTouring The Club application (« Application ») in France, invites you to carefully read this End User License Agreement (« Agreement ») before using the Application. This Agreement governs your use of our Application and incorporates by reference our Privacy Policy, in compliance with the General Data Protection Regulation (GDPR).

By downloading, installing, or using the Application, you (« user, » « you ») agree to be bound by this Agreement. If you do not agree to the terms of this Agreement, you are not authorized to use the Application.

1. Grant of License
Carfooly grants you a limited, non-exclusive, revocable, and non-transferable license to download, install, and use the Application solely for your personal and non-commercial use, in accordance with the terms of this Agreement.

2. User-Generated Content
You are solely responsible for the content you post, upload, or share on the Application. You grant Carfooly a worldwide, perpetual, transferable, sublicensable, royalty-free license to use, copy, modify, distribute, publicly display, and perform the content in connection with the operation of the Application. You may report any inappropriate content directly on the concerned post using the reporting option.

3. Content Moderation
Carfooly is committed to maintaining a safe and respectful environment. We reserve the right to moderate, remove any content, or suspend accounts that violate our usage policies.

4. Content Rights
You represent that you own all rights to the content you post or have all necessary permissions. Carfooly claims no ownership rights over user content.

5. Accounts and Security
You agree to secure your account and maintain the confidentiality of your credentials. Carfooly cannot be held responsible for unauthorized access to your account.

6. Termination
Your right to use the Application terminates immediately upon any breach of this Agreement. Carfooly may also terminate this Agreement at any time without prior notice.

7. Changes to the Agreement
Carfooly may revise this Agreement at any time. Your continued use of the Application signifies your acceptance of the modifications.

8. Applicable Law
This Agreement is governed by the laws of France. Any dispute arising from this Agreement will be subject to the jurisdiction of French courts.
